These Terms and Conditions govern your use of Pivot & Grain's watch repair and maintenance services. By engaging our services or using our website, you agree to be bound by these terms.

1. Definitions

For the purposes of these Terms and Conditions:

  • "Company," "We," "Us," "Our" refers to Pivot & Grain, a watch repair service located at 17 Jalan Dato' Bandar Tunggal, 70000 Seremban, Negeri Sembilan, Malaysia.
  • "Client," "You," "Your" refers to the individual or entity using our services.
  • "Services" refers to watch repair, maintenance, and related services provided by Pivot & Grain.
  • "Timepiece" or "Watch" refers to the mechanical watch submitted for service.
  • "Website" refers to our online presence accessible at pivotaopmy.world.

2. Acceptance of Terms

By submitting your watch for service, contacting us for consultation, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You must be at least 18 years of age to enter into this agreement. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into binding contracts.

3. Service Description

Pivot & Grain provides professional watch repair and maintenance services, including but not limited to:

  • Rotor and automatic winding mechanism servicing
  • Heirloom watch revival and restoration
  • Watch pressure testing for water resistance verification
  • Movement cleaning, lubrication, and regulation
  • Parts replacement and repair

Services are provided at our workshop located in Seremban, Negeri Sembilan. We do not offer mobile or on-site repair services.

4. Service Process

4.1 Initial Assessment

When you submit a watch for service, we will conduct an initial assessment to determine the required work. This assessment may reveal issues not initially apparent. We will contact you before proceeding with any work beyond the originally discussed scope.

4.2 Estimates and Approval

We provide estimates for service work based on our assessment. Estimates are valid for 30 days from the date of issue. We will not proceed with service work without your explicit approval of the estimate.

4.3 Service Timeframe

Timeframes provided are estimates based on our current workload and the complexity of the service. While we strive to meet estimated completion dates, unforeseen circumstances such as parts availability or additional issues discovered during service may extend the timeframe. We will inform you of any significant delays.

4.4 Parts and Materials

We source quality replacement parts from reputable suppliers. When manufacturer parts are unavailable or impractical to obtain, we may use compatible alternatives. We will discuss part options with you when relevant to the service level.

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about your watch's history and any known issues
  • Inform us of any sentimental or exceptional value considerations
  • Respond to our communications regarding service progress and approval requests in a timely manner
  • Collect your watch within 60 days of service completion notification
  • Pay for services as agreed

6. Pricing and Payment

6.1 Service Fees

Our service fees are quoted in Malaysian Ringgit (MYR) and are based on the work required. Published prices are for standard services. Complex or unusual repairs may require custom pricing.

6.2 Payment Terms

Payment is due upon collection of your watch. We accept cash and major credit cards. A deposit may be required for high-value restorations or when ordering expensive parts.

6.3 Uncollected Watches

Watches not collected within 60 days of service completion notification will incur a storage fee of MYR 20 per week. Watches uncollected for more than 180 days may be disposed of in accordance with Malaysian law after reasonable attempts to contact you.

7. Service Warranty

7.1 Warranty Coverage

We warrant our workmanship for a period of 12 months from the date of service completion. This warranty covers defects in our work and parts we have installed. It does not cover normal wear and tear, damage from misuse, or issues unrelated to our service.

7.2 Warranty Exclusions

Our warranty does not cover:

  • Damage from water exposure after pressure testing (seals deteriorate naturally over time)
  • Damage from impacts, drops, or other physical trauma
  • Service by other parties after our work
  • Pre-existing conditions not addressed in the original service
  • Normal aging and wear of components

7.3 Warranty Claims

To make a warranty claim, contact us within the warranty period with a description of the issue. We will assess the claim and, if valid, repair or re-service the watch at no charge. Our warranty obligation is limited to correction of defects in our work.

8. Limitation of Liability

8.1 Service Limitations

Watch repair involves inherent risks, particularly with vintage or damaged timepieces. While we exercise professional care, we cannot guarantee specific outcomes. We provide our services "as is" and make no warranties beyond those explicitly stated in these terms.

8.2 Liability Cap

Our maximum liability for any claim related to our services is limited to the amount you paid for the specific service in question or MYR 5,000, whichever is less. This limitation applies regardless of the form of action, whether in contract, negligence, or otherwise.

8.3 Exclusion of Damages

We are not liable for any indirect, incidental, special, or consequential damages, including loss of use, loss of revenue, or sentimental value, even if advised of the possibility of such damages.

8.4 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, power failures, strikes, wars, or pandemics.

9. Watch Custody and Insurance

While your watch is in our custody, we maintain insurance coverage for theft and damage. However, you are advised to maintain your own insurance for high-value timepieces. We recommend declaring exceptional value at the time of service intake.

Our insurance coverage is subject to policy limits and exclusions. We are not responsible for losses exceeding our insurance coverage limits.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is our property or licensed to us and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without permission.

11. Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy and Malaysia's Personal Data Protection Act 2010 (PDPA). By using our services, you consent to such collection and processing. Please review our Privacy Policy for details.

12. Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12.2 Informal Resolution

In the event of any dispute, we encourage you to contact us first to seek an informal resolution. Many concerns can be addressed through direct communication.

13. Termination

You may cancel a service request before we begin work on your watch. If work has commenced, you will be charged for work completed to date.

We reserve the right to refuse service or terminate our service relationship if you violate these terms or engage in abusive or threatening behavior toward our staff.

14. Changes to Terms

We may update these Terms and Conditions periodically. Changes will be posted on our website with a new "Last Updated" date. Material changes affecting ongoing services will be communicated directly to affected clients.

Your continued use of our services after changes indicates acceptance of the updated terms.

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Pivot & Grain regarding our services and supersede all prior agreements and understandings.
